Privacy Policy

Information that permits inferences to be made about your personal relationships is very valuable. For this reason, the legislators have concluded to protect the corresponding information containing such in particular ways. To make this protection as effective as possible, we would like to show you with these privacy guidelines the purposes for which we publish, process and use data.

This privacy policy applies for all services, which TICKnTALK provides (hereafter Tick&Talk).

1. Data Collection: which information is collected by TICKnTALK?

a) Data which you have already made available to TICKnTALK.

As soon as you decide to register with TICKnTALK, you are requested to create a user account. During this process, you must provide your contact information, which is what first makes communication by means of the TICKnTALK platform and identification possible. This data includes your user name, a valid email address and a password. As soon as you have made these entries, you may use the services of TICKnTALK. This information is stored for as long as your exists with TICKnTALK. Certainly, specific information can be changed as the actual relationship changes over the course of time.

After registration, you can supplement your profile with voluntary information. Primarily, this serves to provide an overview to other TICKnTALK users about the people they are talking with, or which people can use to determine the background of specific contributions. How far you wish to go with this remains your choice, whereby you should always ensure that the information provided by you is correct as provided by TICKnTALK. Of course, we must store this information, so that it can be called up by third parties. It is possible, for example, to enter into relationships with other members, to develop groups, to send messages to other members, to mark (tick) web pages and to comment on them (talks).

The purpose of this type of communication is to be able to exchange information about individual Internet offerings directly, and further recommend and rate them. We collect this voluntarily provided information to provide an overview of the extensive offerings on web pages and their advantages and disadvantages. This communication data can normally be reviewed by you and deleted.

When updating individual entries, backups are temporarily stored for an appropriate period of time. The purpose of this is to protect you from the undesirable loss of your personal data.

Each member is responsible for marking Internet sites as well as their comments. The actions of other users, with whom you share information, cannot be controlled by us. You use TICKnTALK at your own risk. We always endeavor to protect your data from unauthorized access, insofar as such is technically possible. Liability beyond this for illegal access by third parties, in particular unauthorized viewing, copying or storing of your data cannot be accepted by TICKnTALK.

TICKnTALK provides you with the ability to inform associates, co-workers and friends about the services of TICKnTALK. The requirement for this is that you provide an email address for the appropriate person to us. This email address is stored by us for purposes of transmitting information about our services and, if necessary personalized suggestions with regards to certain members, groups or web sites. The owner of the corresponding email address may contact us at any time to request the deletion of this data.

All profile data voluntarily made available to us by you are ultimately made available to those people, to whom you have allowed access. In principle, these are your confirmed friends. Additional limitations are, however, possible. In addition, we do occasionally use your contact data to instruct you about modifications, improvements and updates to our services.

To a limited extent, the information may also be made available to third party search engines as well. This information is limited to your profile picture and your user name. In this manner, it is not possible to acquire more information about you. The procedure should ultimately make effective networking possible and ease search efforts for already existing members.

b) The data acquired by TICKnTALK in an automated manner

Once you have logged into TICKnTALK using your user name, we will send your computer cookies. A cookie is a small file, which contains a specific sequence of characters and uniquely identifies your browser. Using cookies enables us to improve the quality of our service. In that we can replicate the habits of the members while using TICKnTALK, we can also see whether certain services are used more often or are not being accepted by the users. The use of cookies enables us to also replicate whether you have followed a specific link. In this respect, the point to using cookies is to adjust the services offered by TICKnTALK to the needs of the member as effectively as possible.

Additionally, cookies are used as part of the TICKnTALK advertising programs. Since TICKnTALK is provided as a free service, advertising (in particular, personalized advertising) represents the only possibility to provide such services in a professional manner. Should you choose to use TICKnTALK, the use of cookies ultimately benefits you. On the one hand, our services can only be financed in this manner and provided to you; on the other hand, only those advertisements come to you, which might actually be of interest to you. You grant consent related to this as part of the privacy declaration, which you agree to during registration.

Furthermore, TICKnTALK saves log information, which comes to the TICKnTALK servers as soon as you request our web site. This information contains your request from the web, your IP address, the type of browser, its language setting, and the date and time of your request as well as one or more cookies, which uniquely identify your browser. The log information will be stored for a maximum time period of 6 months.

c) Data which will never be collected

The personal data of minors under the age of 13 is never acquired, collected or used. For this reason, persons under the age of 13 are not allowed to register with TICKnTALK.

We recommend that minors between the ages of 13 and 18 request their parents permission before they divulge information about themselves on the Internet.

2. Usage within the scope of the declared purpose and in certain additional cases

TICKnTALK uses personal data for those purposes, which have been described in this privacy policy. This may include the following:
  • The use of all services provided by TICKnTALK, including those services and advertisements that go to the details to the person of the user in a personalized manner.
  • The continuous development and security of our services as well as the effective management of our services.
  • The effective legal protection of persons participating at TICKnTALK.
  • The operation of our advertising network, which ensures financing of our freely available service. We process your data as part of this advertising network such that the inserted advertisements have been precisely customized to your profile. This way, advertisements will be more interesting for you and the advertising company.

The acquired information is stored, insofar and for so long as its storage is necessary for achieving the purpose indicated above.

In principle, personal data is only stored, processed and used for the purposes indicated above. If the desired purpose has been achieved, the data will be deleted as quickly as possible. One exception to this involves any storage obligations for purposes which are prescribed by legal directives.

We only forward data, which permits inferences to be made about your person, without prior express consent, when a legal obligation regarding such affects us. Propagation of information to third parties occurs in the following cases:
  • Pursuant to regulations, marks, comments and messages by third parties may be reviewed.
  • We may be compelled to forward personal data to investigative authorities or private processors on the basis of compelling legal regulations. Naturally, we will only divulge your data when an obvious transgression of the law or a court order are present, which compels us to provide the data.

3. Security and responsibility

TICKnTALK protects your data to the full extent of their power to do such and as is possible within the scope of their technical capabilities. The information stored on our servers is protected by continuously updated backup software. Particularly sensitive data is transmitted with the aid of the highest available security standards (SSL technology). Since we make the capability of secure transmission available, we request that you do not transfer confidential information by means of email or Internet chats.

If you use TICKnTALK, you share certain information (such as personal information, comments, messages, and other information) with third parties. You bear the full risk of sharing this information. Please consider that the personal information, which you publish, as well as comments, messages and other contributions, may be made publicly available. We do not accept liability for content, which you consciously share.

This privacy policy applies exclusively for the services of TICKnTALK. We have no influence on such web sites or their content as may be marked and commented on by members. No responsibility is accepted for foreign content. These web sites may possibly place their own cookies or other files on your computer. We have no influence on the collection, processing and usage of your data by third parties and cannot accept liability in this regard.

Advertisement, which appear on TICKnTALK, may also be delivered to the user directly by third parties. We have no influence on the collection, processing and use of your personal data by third parties. In particular, the advertising sites automatically acquire your IP address. If your browser is setup such that it permits corresponding processes, third parties may also install cookies and similar programs for the collection of data from your computer.

Only the negotiating sites are responsible for the collection, processing and use of personal data. TICKnTALK is not responsible for compliance with the privacy policy on the part of these third parties. The transmission of data by TICKnTALK to third parities does not occur.

4. Modification and deletion of your personal data.

It is possible for you to supplement, modify or delete, your profile data at any time by means of the settings options. This does not ultimately apply to the essential data (user name, email address), without which registration cannot be maintained for factual reasons. Certainly, this essential data may also be amended at any time. Should you decide to deactivate your TICKnTALK account, you may do so at any time without complying with any notification deadlines. Should you irrevocably surrender your account, we will delete all of your existing personal data as quickly as possible. The information may, of course, be retained as backup copies for an appropriate period of time.

The messages, marks and comments exchanged with other members can no longer be modified or deleted.

Certainly, we retain the right to delete your communication data from the public access of the TICKnTALK platform, in the event that such contributions obviously transgress the justified interests of third parties or contain content subject to penal codes.

5. Validity and modification of the provisions.

We retain the right to modify this privacy policy at any time. If such should ultimately involve a nonessential modification, such take effect immediately. If essential components should be modified, we will inform you one month prior to such modification taking effect via email.
